Smoking, Sampling and Consumption Policy

Part of the Experience Participation, Age Verification & Consumption Terms.

6. Assumption of Experience Risk

Festival experiences may involve ordinary risks associated with:

• Walking or uneven terrain
• Physical movement
• Yoga or wellness activities
• Art materials
• Outdoor weather
• Food and beverages
• Allergens
• Smoke or vapor
• Cannabinoid products
• Equipment
• Other participants

By voluntarily participating, each participant knowingly accepts the ordinary and reasonably foreseeable risks associated with the selected activity.

More specialized activities may require additional rules or acknowledgments.

CANNABINOID PRODUCTS

7. Purchasing, Receiving & Sampling

Only attendees who are 21+ with a valid Festival wristband may purchase, receive, sample, possess, or consume cannabinoid products at the Festival.

Service or participation may be refused when:

• Age cannot be verified
• A wristband is missing or questionable
• The attendee appears excessively impaired
• Participation would be unsafe
• A transaction creates a legal, compliance, or safety concern

Attendees may not obtain cannabinoid products for someone who is not eligible to receive them.

8. Products Permitted for Festival Consumption

Cannabinoid products consumed at the Festival must be lawful products purchased or received during the event from:

• An approved Festival vendor
• An authorized Festival experience
• An official Festival promotion

Outside cannabinoid products may not be brought onto Festival property for consumption.

NC Canna Market may prohibit or require removal of a product when its source, legality, labeling, or safety cannot reasonably be verified.

9. Sampling

Cannabinoid sampling may occur only through approved vendors or authorized Festival experiences.

Samples may not be:

• Provided without age verification
• Distributed through unattended self-service
• Provided to an excessively impaired attendee
• Left unattended or freely accessible
• Distributed contrary to Festival serving limits

Vendors and experience operators may refuse additional sampling at their discretion for safety or compliance reasons.

10. Festival Serving Limits

Unless a lower limit applies, individual servings intended for on-site consumption may not exceed:

• 10 mg Delta-9 THC per serving
• 50 mg total cannabinoids per serving

A beverage serving or sample may not exceed:

• 10 mg Delta-9 THC per serving

These are maximum Festival serving limits, not recommended personal doses.

Servings may not be intentionally divided, combined, or repeatedly distributed for the purpose of avoiding Festival limits.

CONSUMPTION

11. Permitted Consumption

Attendees who are 21+ with a valid Festival wristband may consume permitted cannabinoid products outdoors where Festival and venue rules allow.

Permitted forms may include:

• Smoking
• Vaping
• Dabbing
• Edibles
• Beverages
• Other lawful cannabinoid products

Attendees must follow posted signs and staff instructions.

12. Non-Consumption Areas

Smoking, vaping, dabbing, sampling, and cannabinoid consumption are prohibited:

• Inside buildings
• Inside enclosed indoor areas
• Within the playground area
• In designated non-consumption areas
• In any temporarily restricted area

NC Canna Market or the venue may modify consumption areas when necessary because of:

• Weather
• Fire risk
• Crowd conditions
• Emergency response
• Safety concerns
• Venue requirements
• Applicable legal requirements

13. Responsible Consumption

Cannabinoid consumption is voluntary.

Participants are responsible for:

• Reviewing available potency information
• Reviewing ingredients
• Understanding their personal tolerance
• Avoiding unsafe combinations
• Securing products in their possession
• Stopping consumption if they feel unwell
• Following staff and vendor instructions
• Arranging safe transportation

Do not drive or operate a vehicle while impaired.

Receiving one sample or serving does not create a right to receive additional servings from another vendor or experience.

14. Allergens & Ingredients

Experiences may involve food, beverages, cannabinoid products, botanicals, supplements, art materials, or other substances that may cause allergies or sensitivities.

Participants are responsible for:

• Reviewing available ingredients
• Asking questions before consuming or participating
• Disclosing relevant allergies when appropriate
• Declining products or activities when uncertain

NC Canna Market does not guarantee an allergen-free, cross-contact-free, smoke-free, vapor-free, or fragrance-free environment.

THIRD-PARTY OPERATORS & LIABILITY

18. Independent Experience Operators

Some Festival experiences may be operated by independent instructors, artists, guides, vendors, businesses, or other third parties.

Those parties remain responsible for their own:

• Services
• Products
• Equipment
• Representations
• Qualifications
• Personnel
• Legal compliance

Festival participation or approval does not guarantee that a particular activity, product, or service is suitable for every participant.

19. Release & Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS.

Participation in Festival experiences and voluntary cannabinoid consumption involve inherent and reasonably foreseeable risks.

To the fullest extent permitted by North Carolina law, each participant knowingly and voluntarily assumes those risks and releases and agrees not to sue or hold liable:

• GKD Supply LLC
• NC Canna Market
• NC Canna Festival
• Altadore Investments LLC
• The Plant
• Their respective owners, members, officers, employees, volunteers, contractors, agents, sponsors, and authorized representatives

for claims, injuries, losses, damages, or expenses arising from the ordinary and inherent risks of voluntary experience participation or permitted cannabinoid consumption, including claims based on ordinary negligence to the extent such claims may lawfully be released.

These risks may include:

• Outdoor conditions
• Physical activity
• Uneven terrain
• Food or beverages
• Allergens
• Smoke or vapor
• Voluntary cannabinoid consumption
• Equipment
• Independent operators
• Other participants
• Other risks reasonably associated with the selected activity

Nothing in these Terms releases or limits liability for gross negligence, willful or intentional misconduct, or liability that cannot lawfully be released.

EXPERIENCE CHANGES

20. Schedule & Availability

Experience times, locations, operators, capacity, included products, and programming may change because of:

• Weather
• Safety
• Staffing
• Product availability
• Vendor changes
• Legal requirements
• Venue requirements
• Operational needs

When reasonably possible, NC Canna Market may provide a comparable replacement, rescheduled time, or substitute benefit.

Refund eligibility for cancelled or materially changed paid experiences is governed by the Ticket, Refund, Transfer & Event Changes Policy.

21. Changes to Legal or Safety Requirements

NC Canna Market may modify experience, age-verification, sampling, or consumption rules when reasonably necessary because of:

• Changes in applicable law
• Government or regulatory action
• Venue requirements
• Fire or emergency conditions
• Public safety concerns

Participants must follow the rules in effect at the time of participation.

FINAL TERMS

22. Incorporated Policies

These Terms should be read together with:

• Master Attendee Terms & Conditions
• Ticket, Refund, Transfer & Event Changes Policy
• Festival Safety, Conduct & Prohibited Items Policy
• Applicable competition rules
• Camping Rules & Waiver, where applicable
• Other activity-specific requirements

A more specific activity agreement controls when it directly conflicts with these general Terms.

23. Electronic Acceptance

These Terms may be accepted through:

• Checkout
• Electronic checkbox
• Jotform
• QR-code acknowledgment
• Electronic signature
• Experience registration

When technically available, the Festival should retain:

• Participant name
• Email
• Order or registration number
• Agreement version
• Date and time of acceptance
• Electronic response

Before participating in an organized Festival experience, require:

I confirm that I am at least 21 years old and understand that participation may involve age verification, Festival safety requirements, assumption of risk, cannabinoid products or consumption, and a release and limitation of liability.
